What Happens If You Die Without a Will: A Guide for Parents to Protect Their Children. My personal experience

As a licensed midwife and women’s health advocate, I support women and families through preconception, pregnancy, birth, and postpartum. One of the most overlooked parts of preparing for a family is estate planning. Understanding what happens if you die without a will, and having a clear plan in place, is one of the most important ways to protect your children and their future.

Why Planning Ahead Matters for Families

No one wants to think about an untimely death. It feels heavy and far away from the life you are building. But through the recent loss of my children’s father, I have seen firsthand how important this preparation truly is.

He left behind four children, including a 12-year-old he was the primary caregiver for. There was no clear will, no organized life insurance information, no instructions for his business, and no documented guardianship plan. What followed has been incredibly painful for everyone involved.

Instead of simply grieving, his children, parents, and siblings have had to navigate probate, legal confusion, and financial uncertainty without guidance. They are doing their best and coming together with love, but the added stress during an already devastating time has been overwhelming. Most heartbreaking of all, his son has been left without clear direction about his care and future.

What Happens If You Die Without a Will

When a parent dies without a will, the court steps in to make decisions. This process, known as probate, can be long, expensive, and emotionally draining for families.

Without a will in place:
There is no clear legal guardian named for your children
Your family may have to go through court to determine custody
Access to finances and assets can be delayed
Your wishes for your children, home, or business are not clearly known

Even in loving families, this can create confusion, stress, and added pain during a time of grief.

How to Protect Your Children and Family

As women, we plan so much. We prepare for birth, create registries, and think deeply about how to care for our babies. But one of the most important acts of love is planning for their future if you are no longer here.

If something were to happen to you and your partner, who would care for your child? Would they know your wishes? Would they have the financial support needed to raise your child?

Planning ahead gives your family clarity, stability, and peace.

Simple Steps Every Parent Should Take

Create a will that clearly outlines your wishes and names a guardian for your children
Set up a life insurance policy to provide financial support for your child’s future
Organize important documents including passwords, accounts, insurance policies, and business information
Store everything in a secure place and share access with a trusted family member, friend, or attorney
Have conversations with those you trust so they understand your wishes and are prepared

This can be part of your preconception planning, your baby shower preparation, your birth plan, or something you prioritize today if you already have children.

A Final Note from My Heart

I am sharing this not as a sales message, but from a place of deep care after watching my own children and their extended family walk through something that could have been made so much easier with preparation.

Taking the time to create a will, set up life insurance, and organize your plans is one of the greatest gifts you can give your children. It ensures that, even in the unimaginable, they are protected, supported, and cared for in the way you would have wanted.

If you are preparing for pregnancy, navigating postpartum, or focusing on your overall women’s health, this is an important part of your plan. I am always here to guide you or connect you with trusted professionals who can help you take these steps with confidence.

This is love in its most practical and powerful form.
